Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Agent that includes:

3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the party who filed the original DMCA Notice or its agent.

Upon receipt of a valid counter-notification, we may restore the removed material in accordance with the DMCA, unless the original complainant files a court action seeking to restrain the allegedly infringing activity.

Repeat Infringers

We reserve the right, in appropriate circumstances and at our sole discretion, to disable or terminate the accounts of users who are determined to be repeat infringers.

Guest Photos, Reviews & Social Media

Guest photos, reviews, and social-media posts submitted or tagged to Smokey and the Brisket (including via Instagram, Facebook, Yelp, or Google) may be shared or reposted by us for marketing purposes. If you believe we have used your photo or content without authorization, contact us using the Designated Agent information above and we will address it promptly.

Ownership of Site Content

Except for user-submitted content, all content on the Site — including text, graphics, logos, images, menus, food photography, and software — is the property of Smokey and the Brisket or its licensors and is protected by copyright and other intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written permission.
